Facts
John Orwa and George Okinyi Omamba were contestants for nomination by the Orange Democratic Movement Party for a position in the County Assembly. The nomination was held on 24th April, 2017. The respondents attempted to deny Orwa his victory and declined to issue him with a nomination certificate. Orwa lodged a complaint with the Migori County ODM Elections Appeals Tribunal, which ordered the respondents to issue the final nomination certificate. The respondents failed to comply, and Orwa escalated the matter to the Political Parties Disputes Tribunal, which ordered the recall of the nomination certificate in his favor.
