Facts
Land parcel No. 3164–Mitaboni Adjudication section was registered in the name of Ngotia Ndolo, who was hived off/excised from land parcel No. 15–Mitaboni Adjudication section. Ngotia Ndolo died in 2022, and the applicant was issued with letters of administration of his estate. The case was initially heard as a Minister’s Appeal Case No. 235 of 1989, but was not heard due to the deaths of the parties involved.
Issues
- Whether the District Commissioner-Kathiani’s ruling in the land appeal case is tainted with illegality, irrationality, and procedural impropriety.
- Whether the District Commissioner-Kathiani or any Land Officer/Surveyor should be prohibited from implementing and executing the ruling.
Reasoning
The court held that the application was not opposed by the Respondent or the interested party, and the applicant's averments were not controverted. The court found that the decision-making authority did not follow the correct process, leading to a breach of the rules of natural justice and the decision being based on irrelevant considerations.
Outcome
Application dismissed.
